The Western Grains Research Foundation is repaying nearly $871,000 to Canadian Pacific Railway.

The payment comes after CPR appealed a notice from the Canadian Transportation Agency that required it to pay $1.6 million for going over its grain freight rate cap for the 2005-2006 crop year.

 

Lanette Kuchenski, the Foundation's Executive Director, says there is no way for the WGRF to appeal the decision.

 

Kuchenski says it's already gone through the Federal Court of Appeal, adding that, unfortunately, there seems to be some loop holes in the revenue cap and the way it's been legislated.

 

Kuchenski says CN has launched a similar appeal that will be heard early in 2008.
